Julius Malema’s ‘dead white man’ tweet is hate speech, says SAHRC

Julius Malema’s comments on Twitter will be referred to the equality court and the SAHRC will also investigate the EFF’s ban on media organisations amaBhungane and the Daily Maverick from their events.

The South African Human Rights Commission (SAHRC) on Tuesday condemned recent comments attributed to EFF leader Julius Malema — at least at first sight — as amounting to hate speech.

They were referring to a video shared on his Twitter feed in which he paid tribute to the late former Zimbabwean president Robert Mugabe.

The tweet, published on September 14 with the words “Rest in power #GUSHUNGO” featured a video with quotes by Mugabe. “The only white man you can trust is a dead white man,” read one of the quotes alongside a picture of Mugabe.

AfriForum’s Ernst Roets not in contempt of court over apartheid flag tweet – Roets said he was posing an academic question with his tweet

Johannesburg – The Equality Court on Tuesday ruled that AfriForum deputy chief executive Ernst Roets was not in contempt of court when he tweeted an image of the offensive apartheid flag.

Roets posted the image on Twitter soon after the Equality Court, sitting at the South Gauteng High Court, declared that the gratuitous display of the apartheid flag amounts to hate speech.

Judge Phineas Mojapelo said displaying the old flag constituted hate speech and discrimination based on race. He added that the apartheid-era flag be allowed for academic, artistic and journalistic use only if there was a need and permission to do so.

Roets’ offensive post prompted the Nelson Mandela Foundation to file bring an urgent application to the court.

However, Roets dismissed suggestions that he disrespected the judgment. Instead he said the court ruled the flag could be used for artistic, journalistic and academic purposes.

The group was in the Equality Court on Tuesday in the matter between itself and a complainant represented by the South African Human Rights Commission (SAHRC).

The Black First Land First (BLF) movement says it has no money for legal representation in its court battles.

The group was in the Equality Court on Tuesday in the matter between itself and a complainant represented by the South African Human Rights Commission (SAHRC).

The complainant has accused the BLF of using hate speech.

The BLF says that groups and people who have taken them to court over various incidents are opportunistic as they know that they cannot afford legal representation.

Deputy president Zanele Lwana explains: “It is a lot of money to pay for legal representation in this country. We already have an overwhelming amount of legal costs from racists, including AfriForum, who want to see our movement destroyed and punished through legal costs.”
